Special Action Lawsuit

This is a developing lawsuit with the Town of Dewey-Humboldt and we do not have all the information yet.

The Town Meeting on 9-1-2026 revealed that Robert Davis (was running for council and appears to be elected outside of the runoff) has record request(s) that have not been filled promptly by the Town. His solution was to file a Special Action Lawsuit with Yavapai Superior Court for Records.

What is a Special Action Lawsuit for Public Records?

A Special Action is a legal process that allows someone to ask the Superior Court to review whether a government agency has improperly denied or failed to provide requested public records.

Simply put:

You requested public records → the government did not provide them → you ask a judge to review the matter and enforce Arizona’s Public Records Law.

Arizona law provides for this process under A.R.S. § 39-121.02.
